Bicyclists are constantly at risk from distracted drivers who don’t take the time to check for a defenseless rider who may be sharing the street. The lack of attention to the road only gets worse after the sun goes down. A driver’s lack of care at night leads to an elevated risk when even more caution is required to keep everyone in the lanes safe.

The Insurance Institute of Highway Safety (IIHS) found that nearly 40% of all fatal bicycle accidents in 2018 took place between 6 p.m. and midnight.  Another 16% of nationwide deaths took place between midnight and 6 a.m.

These tragic nighttime accidents can leave riders with serious injury and even cost them their lives.

Bicyclist Struck and Killed in Compton

A man bicycling in Compton was hit and killed late Wednesday Night. My News LA reported the accident happened around 11:15 p.m. along Rosecrans Avenue near Aprilia Avenue on September 16, 2020.

The California Highway Patrol arrived on the scene to find a 40-year-old man lying on the road. He was unresponsive. Investigators say the man was riding on a poorly lit stretch of road when a Honda Element changed lanes and struck the rear of the bike.

The bicyclist was later pronounced dead by the Compton Fire Department. The driver of the Honda stayed on the accident scene for the investigation.

Help for the Family Left Behind After a Bicycle Accident

After a fatal bicycle accident, there will always be family and friends devastated when they get the tragic news. They will realize a loved one won’t return from a ride and what’s worse the carelessness of a driver may have been to blame.

In these difficult times, those that counted on the victim for emotional and financial support will need to ensure the at-fault driver is held accountable. The close family left behind may file a wrongful death claim in order to recover damages from the driver and his or her insurance company. A representative for the family such as a spouse or domestic partner or children of the deceased can bring the claim forward.

This civil lawsuit won’t be able to replace the love and support the loved one provided, but it can make sure the family doesn’t struggle with the financial burden now and in the years to come. A wrongful death claim can demand restitution for things like funeral costs and medical expenses. The paychecks the deceased victim would have provided to the family had he or she lived can also be compensated. Compensation for the emotional support a victim would have provided to a spouse or children over a lifetime can also be requested.

In California, a family has up to two years from the date of an accident to file a wrongful death claim. It is recommended that the family file as soon as they are able because if months or years go by it can be more difficult to gather evidence and documents needed for the case. An attorney can help the family prepare a strong case to earn a settlement or a successful court ruling on the wrongful death claim.
