Uber is the largest and most successful transportation network company in the world. It’s incredibly popular in and around Los Angeles, and in most cases, it’s less expensive and more convenient than taking a taxi. As Uber proliferated in the Los Angeles area, accidents increased. Some of those accidents involve bicyclists.

The Insurance Issue
What the Uber driver was doing at the time of your accident determines what insurer might cover your accident. If a driver was operating their vehicle for purposes of personal use with the Uber app in the car turned off, that the driver’s own personal insurance would be covering the accident. If the Uber app is turned on, the driver is covered by Uber’s own insurance, It’s broken down into three separate stags. Here’s how it works.
- Stage One: This is when the vehicle is either being used for personal purposes, or it’s not being used at all and parked. During this stage, the driver’s own personal insurance covers the vehicle.
- Stage Two: Now, the driver has logged into the Uber app and is available to transport Uber customers. Coverage of $50,000 per person and $100,000 per accident applies.
- Stage Three: The driver has now accepted a passenger off of the app, $1 million of liability coverage is triggered. That coverage remains in effect until such time as the customer reaches his or her destination and leaves the vehicle. If you are a bicyclist, and an Uber driver negligently injures you during this third stage, that $1 million of coverage would likely apply. There is also $1 million of uninsured and underinsured motorist coverage.
